The SAGITINE website is operated under license by Ten Zero Three Pty Ltd trading as Sagitine (ABN No 19 656 008 721) whose registered office is located at: 2 Elizabeth Bay Road, Elizabeth Bay. By accessing and using the Sagitine website, you are consenting to the terms and conditions of this site as well as the collection of information. Sagitine Pty Ltd endeavours to keep the information on the Sagitine website up to date, however it may contain errors or inaccuracies at time of viewing. The Terms may be updated by us from time to time. Any changes to our terms of use will be posted here. Your use of the services and websites show acceptance of any updated Terms.

WAREHOUSE SALE APRIL 2024

The offer pricing is the prices marked for goods purchased through the Sagitine website at www.sagitine.com.  This excludes all pre-orders already placed and purchases made through third parties, affiliate sites or other retail or e-commerce partners. The offer is only valid on the retail price of the goods and not on shipping and delivery costs. The offer cannot be used in conjunction with any other offer.

The promotional period will run from 7 am, ADST, April 2 and finish at midnight on April 30th or when stock is sold out, whichever happens, sooner. The offer is not valid for cash or cash equivalents and is only available during the promotional period. The offer cannot be applied to previous purchases or stored for future use.

Returns for an exchange or a refund are not eligible on discounted or promotional items.

Terms Of Sale

When purchasing items vai the Website, you agree that these Terms apply to each order you place. If you are entering into these Terms on behalf of another entity, you do so representing that you have the authority to bind that entity to these Terms. If you do not have the authority or do not agree to these Terms, you are not permitted to use the Website or services. Sagitine reserves the right to accept or decline orders made through the Sagitine Website. All orders are subject to availability and confirmation of the order. When you place an order, you’ll receive an acknowledgement e-mail confirming receipt of your order; this email will only be an acknowledgement and will not constitute acceptance of your order. Acceptance of the order happens at the time goods goods have been dispatched. Occasionally, certain goods may be out of stock or be subject to long lead times. The estimated lead-times are an approximation only and are subject to change. If we are unable to fulfil your order, we will refund you the price of the goods and shipping.

Pricing

All prices listed on the website are in Australian Dollars unless otherwise specified. All orders will be charged in AUD. Delivery costs may be charged in addition to the product price. Sagitine reserves the right to alter, update or change the pricing of any item available on the site at any time and the price of shipping.

Pre-Orders

All pre-order Products are subject to full payment upfront including taxes and shipping. Once the pre-order has been placed it cannot be cancelled. Any delays, production changes, or issues will be communicated to the customer within 7 days of being confirmed by the manufacturer. Any other cancellation requests are at the discretion of Sagitine.

Payment

Sagitine accept online payments from all major credit and debit cards, Paypal, Apple Pay and Google Pay. All payments will be processed in AUD. 

Discount

Only one discount code can be used per order unless otherwise specified and is not redeemable for cash. Discount codes are valid during promotion time and cannot be used at a later date. Discount codes must be applied at the time of checkout. The code cannot be applied to any orders retrospectively. Products may be marked down at Sagitine’s discretion. Marked-down prices cannot be applied to any orders retrospectively.

Delivery

Please refer to our Shipping policy. The Customer must inform Sagitine of any issues, difficulties or specific requirements associated with the delivery of the products and must ensure that the item ordered is capable of delivery. I.e through doorways and up staircases. Someone aged over 18 must be present and able to accept the delivery at the delivery address supplied by the customer. Unforeseeable circumstances may impact delivery within the agreed timeframe. Risk and liability in goods passes to the purchaser at the time of delivery of the Goods to your nominated address. 

Returns

Please refer to our Returns Policy. Unless otherwise specified, we do not offer returns or a refund on any discounted product, unless faulty or damaged. This includes marked down items, sale products or items discounted through marketing/promotions/code discounts.

Product Warranty

Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality and the failure does not amount to a major failure within a reasonable timeframe.

Intellectual Property

Sagitine is the owner or the licensee of all intellectual property rights on the website, and in the material published on it. Such works are protected by copyright laws and treaties around the world. All such rights are reserved. You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors. All intellectual property of Sagitine Pty Ltd such as trademarks, trade names, patents, registered designs and any other automatic intellectual property rights derived from the aesthetics or functionality of the website remain the property of Sagitine Pty Ltd. By using the Website you agree to respect the intellectual property rights of Sagitine Pty Ltd and will refrain from copying, downloading, transmitting, reproducing, printing, or exploiting for commercial purpose any material contained within the website. All infringements of Sagitine Pty Ltd intellectual property rights will be prosecuted to the fullest extent of the law.

All users are responsible and legally liable for their activity, behaviour, use of and conduct on the Sagitine website. Comments or opinions expressed on our blog are those of the respective contributors only. The views expressed on our blog within such comments do not necessarily represent the views of Sagitine. Liability

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. Sagitine Pty Ltd will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of the website. Nothing within this Agreement will operate to exclude any liability for death or personal injury arising as result of the negligence of Sagitine Pty Ltd, its employees or agents.

Governing Laws and Jurisdiction 

This agreement will be governed by the laws of the state of New South Wales in Australia supplemented by all federal laws of Australia where applicable, and any user of the website hereby agrees to be bound exclusively by the jurisdiction of Australia courts without reference to rules governing choice of laws. Severance If any provision of this agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.
